The German version on the website shall have legal relevance. This English version is only intended for translation purposes and is purely informative.

Terminology used

“Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (such as a cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Relevant legal bases

We shall inform you of the legal bases of our data processing in accordance with Article 13 GDPR. If the legal basis is not indicated in the Privacy Policy, the following shall apply: The legal basis for the obtaining of consent is Article 6(1)(a) and Article 7 GDPR. The legal basis for processing to perform our services and implement contractual measures, as well as to respond to enquiries is Article 6(1)(b) GDPR. The legal basis for processing to fulfil our legal obligations is Article 6(1)(c) GDPR. The legal basis for processing to protect our legitimate interests is Article 6(1)(f) GDPR. In the event that processing is necessary in order to protect the vital interests of the data subject or of another natural person, Article 6(1)(d) GDPR shall form the legal basis.

Evaluation of access via Matomo

This website uses Matomo, open-source software for statistical evaluation of user access. Matomo uses so-called “cookies”, which are text files stored on the user’s computer that enable analysis of how the user uses the website. The information generated by the cookie about the use of this website is stored on the provider’s server in Germany. The IP address is anonymised immediately after processing and before storage. Users can prevent the installation of cookies via the appropriate setting in your browser software; however, the provider points out that, in this case, the user may not be able to completely utilise all functions of the website.

Information on viewing pages

When viewing individual pages and their offers, data shall be stored through this process in anonymised form in a log file. This storage is for internal system-related and statistical purposes only.

Specifically, the following types of data are stored each time the page is viewed:

  • Names of the file retrieved
  • Date and time of access
  • Data volume transmitted
  • Description of the type of web browser used
  • Requesting domain

Personal data are not stored during this process. This website only uses this information to regularly improve and update the website and so to increase the attractiveness of the offers.

IWAKI Europe GmbH uses these data to respond to enquiries and to inform users about future offers and services of the company. Transmission to third countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or this happens through the use of third-party services or disclosure or transfer of data to third parties, this shall only occur to fulfil our (pre)contractual duties on the basis of your consent, a legal obligation or our legitimate interests. Subject to statutory or contractual permission, we process or have the data processed in a third country only under the particular conditions of Article 44 GDPR. Consent

By using our website and voluntarily disclosing your personal data, e.g. in our online registration form, you consent to the use of your data for the purposes mentioned. Further processing of your personal data beyond these purposes or disclosure to third parties shall not occur without your consent.

Data subject rights

You have the right to request confirmation of whether data concerning you are being processed and to request access to these data, as well as to additional information and copies of the data, in accordance with Article 15 GDPR. In accordance with Article 16 GDPR, you have the right to request completion of the data concerning you or rectification of incorrect data concerning you. In accordance with Article 17 GDPR, you have the right to request that data concerning you be erased immediately, or alternatively, in accordance with Article 18 GDPR, to request restriction of processing of the data. In accordance with Article 20 GDPR, you have the right to request that you receive the data concerning you which you have provided to us and to request transmission to other controllers. In addition, in accordance with Article 77 GDPR, you have the right to lodge a complaint with a supervisory authority.

Right to revoke

In accordance with Article 7(3), you have the right to revoke your consent with effect for the future.

Right to object

In accordance with Article 21 GDPR, you can object to future processing of data concerning you at any time. The objection can occur particularly against processing for purposes of direct advertising.

Security

IWAKI has implemented up-to-date technical security measures to protect data provided from accidental or wilful manipulation, loss, destruction or access by unauthorised persons. In the event of collection and processing of personal data, the information is transmitted in encrypted form.

SSL or TLS encryption

For security reasons and to secure the transmission of confidential information, such as enquiries that you send to us as the site operator, this website uses SSL or TLS encryption. You can recognise an encrypted connection because the address line of the browser changes from http:// to https:// and there is a lock symbol in your browser line. If SSL or TLS encryption is activated, the data that you transmit to us cannot be read by third parties.

Cookies, control elements and scripting

Certain offers or services of this website use so-called cookies, which are small text files that are stored on your computer and allow the website to support and automatically recognise the user at the next visit. Correspondence

Within the scope of our business operations, we may in certain circumstances contact you as the correspondent by means of direct contact or by letter. We would like to point out that your direct contact details (extension number and email address) are stored with us along with your company’s data. If the contact person in your company changes, please inform us of this. We shall then delete your direct contact details and replace them with those of the new person. We shall use these data to respond to enquiries and to inform you about future offers and services of the company.

Storage period

The personal data transmitted shall be retained for 10 years in the event that an agreement is concluded pursuant to Sections 238, 257 IV HGB (Commercial Code) / Section 147 II AO (Fiscal Code). The personal data transmitted by contact form for which further storage is not required shall be erased after 3 months.
